GENERAL TERMS AND CONDITIONS

Article 1 – General Information

These Terms and Conditions apply to all courses, workshops, and other services offered by NEST Aquarel Atelier Amsterdam, a VOF registered in the Netherlands.

By completing a booking and payment on our website (www.nestaquarel.com), the participant agrees to these Terms and Conditions in full. These Terms and Conditions apply to all bookings made on or after 11 May 2026.

Where Dutch consumer law (consumentenrecht) provides stronger protections than these terms, applicable law prevails.

In these Terms and Conditions: – "Course" means a multi-session programme spread over several weeks (e.g. a 5-week or 8-week course). – "Workshop" means a single-session event held on a specific date, also referred to on our website as a "masterclass". The terms "workshop" and "masterclass" are used interchangeably and are subject to the same conditions.

Article 2 – Registration and Payment

2.1 Registration is completed exclusively through our website. A booking is confirmed only upon receipt of full payment via Stripe.

2.2 Full payment is required at the time of booking. No partial payments or instalment plans are available unless explicitly agreed in writing.

2.3 By ticking the confirmation checkbox and completing payment, the participant confirms they have read, understood, and agreed to these Terms and Conditions.

2.4 A place in a course or workshop is secured only upon confirmation of full payment.

Article 3 – Right of Withdrawal (Herroepingsrecht)

3.1 As purchases are made online, participants who are consumers have the right to withdraw from their booking within 14 days of purchase, without providing a reason, in accordance with EU Directive 2011/83/EU and Dutch law.

This right of withdrawal does not apply to workshops. Workshops are leisure activities provided on a specific date and are therefore exempt from the right of withdrawal under Article 6:230p(e) of the Dutch Civil Code. The applicable cancellation terms for workshops are set out in Article 4.4.

3.2 However, by ticking the confirmation checkbox at the time of booking, the participant expressly requests that the service begins before the 14-day withdrawal period expires, and acknowledges that the right of withdrawal is forfeited once the first class of the course or workshop has taken place.

3.3 If the participant exercises the right of withdrawal before the first class takes place, a full refund will be issued within 14 days.

Article 4 – Cancellation by the Participant

4.1 Cancellation before the start date

A participant may cancel their registration free of charge up to 7 calendar days before the start date of the course or workshop. A full refund will be issued within 14 days of the cancellation request.

Cancellation requests must be submitted in writing to info@nestaquarel.com.

Cancellations received less than 7 calendar days before the start date are not eligible for a refund.

This 7-day cancellation policy applies without prejudice to the participant's statutory right of withdrawal under Article 3. Where the 14-day withdrawal period still applies and the course has not yet started, the participant is entitled to a full refund regardless of the 7-day deadline.

4.2 Cancellation after the first class (courses only)

If, after attending the first class, a participant decides the course is not the right fit, they may request a refund for the remaining sessions within 72 hours of the first class taking place.

In this case, a fee of €70 will be retained for the attended session, regardless of any discount applied at the time of booking. The remaining balance will be refunded within 14 days.

This option applies to multi-week courses only and is not available for single workshops.

4.3 Missed classes

Attendance is the sole responsibility of the participant. NEST Aquarel Atelier Amsterdam does not take attendance during sessions.

No refunds are issued for classes missed by the participant once a course is underway, except as described in Article 4.2 above.

As a goodwill gesture, participants may request to attend one (1) make-up class per course by joining another available group, subject to the following conditions:

• The request must be submitted to info@nestaquarel.com at least 48 hours before the session the participant wishes to attend.
• Make-up classes are subject to availability and are not guaranteed.
• This option does not apply to single workshops.

4.4 Single workshops

As workshops are leisure activities provided on a specific date, the statutory right of withdrawal does not apply (see Article 3.1). The following cancellation terms apply instead:

– Cancellations made 14 or more calendar days before the workshop date: full refund. – Cancellations made between 7 and 14 calendar days before the workshop date: 50% refund. – Cancellations made less than 7 calendar days before the workshop date, or no-shows: no refund.

Individual workshops may be subject to specific cancellation terms, which will be clearly stated on the workshop's page at the time of booking. Where such specific terms are stated, they take precedence over the default terms above.

4.5 Sending a replacement participant

If a participant is unable to attend a course or workshop, they may transfer their place to another person, provided they notify us in writing at info@nestaquarel.com in advance with the replacement participant's details. This option is available for both courses and workshops.

Article 5 – Transfer to Another Course

5.1 A participant who is unable to attend a booked course may request a transfer to a future course, subject to the following conditions:

• The transfer request must be submitted in writing to info@nestaquarel.com before the first class of the original course.
• Transfers are only available to a course of the same type and the same price. No refund is issued if the participant chooses not to use the transfer.
• A maximum of two (2) transfers are permitted per participant per course.
• Transfers are subject to availability in the requested future course.
• No transfer is permitted after the course has started.

5.2 Transfers are not available for single workshops.

Article 6 – Cancellation by NEST Aquarel Atelier Amsterdam

6.1 NEST Aquarel Atelier Amsterdam reserves the right to cancel a course or workshop, including in the event that the minimum number of participants (6) has not been reached, or due to instructor unavailability or other circumstances beyond our reasonable control.

6.2 In the event of cancellation by NEST Aquarel Atelier Amsterdam, participants will be notified at least 3 calendar days before the start date, or as soon as reasonably possible in the case of unforeseen circumstances.

6.3 Participants are entitled to a full refund, processed within 14 days, or may opt to transfer to a future course in accordance with Article 5.

6.4 If an individual session within a course is rescheduled by NEST Aquarel Atelier Amsterdam, participants who are unable to attend due to the change are entitled to a pro-rata refund for that session upon written request.

Article 7 – Force Majeure

7.1 NEST Aquarel Atelier Amsterdam is not liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to pandemic, government restrictions, fire, flooding, or other events of force majeure.

7.2 In such cases, NEST Aquarel Atelier Amsterdam will make reasonable efforts to offer participants a studio voucher or transfer to a future course. No monetary refund is guaranteed in force majeure situations, unless required by applicable law.

Article 8 – Gift Certificates

8.1 NEST Aquarel Atelier Amsterdam offers gift certificates in the form of electronic discount codes, generated via Stripe. A gift certificate may cover the full or partial cost of a course or workshop.

8.2 Gift certificates are available as promotional certificates, where the face value (the amount credited) may differ from the purchase price. In all cases, only the amount actually paid by the purchaser is eligible for refund.

8.3 Gift certificates may be transferred to or used by another person. The certificate code may be shared freely.

8.4 The following conditions apply to the use of gift certificates:

• A gift certificate may be applied toward any course or workshop offered by NEST Aquarel Atelier Amsterdam.
• Gift certificates cannot be combined with other discounts, promotional pricing, or early-bird offers.
• If the face value of the certificate exceeds the price of the selected course or workshop, the remaining balance is forfeited and cannot be applied to future purchases.
• It is the responsibility of the purchaser or recipient to ensure the certificate is applied to a product of equal or greater value than the certificate’s face value.

8.5 Each gift certificate has a validity period, which is stated on the product page at the time of purchase, in the confirmation email, and in the certificate PDF sent to the purchaser. Certificates that are not used before the expiry date are forfeited and cannot be extended or refunded.

8.6 The purchaser of a gift certificate may request a full refund of the amount actually paid within 14 calendar days of the date of purchase, provided the certificate has not yet been redeemed. Refund requests must be submitted in writing to info@nestaquarel.com. After 14 days, the certificate can only be used and is no longer eligible for a monetary refund.

8.7 Refunds are issued to the original purchaser only. If a certificate has been gifted to another person, any refund will still be processed to the original payment method of the purchaser.

8.8 If a participant uses a gift certificate (in full or in part) to pay for a course or workshop that is subsequently cancelled in accordance with these Terms and Conditions, the following applies:

• Any amount paid by card or other payment method (in addition to the certificate) will be refunded to the original payment method.
• The gift certificate will be reinstated with its original expiry date.

Article 9 – Studio Vouchers

9.1 NEST Aquarel Atelier Amsterdam may, at its discretion, issue studio vouchers as an alternative to monetary refunds or as a gesture of goodwill.

9.2 Vouchers are valid for the period stated on the voucher and may be applied toward any course or workshop offered by NEST Aquarel Atelier Amsterdam.

9.3 Vouchers are non-transferable, cannot be exchanged for cash, and cannot be combined with other discounts or early-bird offers unless explicitly stated.

Article 10 – Liability

10.1 NEST Aquarel Atelier Amsterdam is not liable for any loss, damage, theft, or injury suffered by participants during a course or workshop, except in cases of gross negligence or wilful misconduct on the part of NEST Aquarel Atelier Amsterdam.

10.2 Participants are responsible for their own health and safety and are advised to inform the instructor of any relevant medical conditions prior to participation.

10.3 NEST Aquarel Atelier Amsterdam is not liable for indirect or consequential losses, including but not limited to travel costs or loss of income.

Article 11 – Privacy

Personal data collected during the registration process is processed in accordance with our Privacy Policy, available at http://nestaquarel.com/en/privacy-policy. We do not share personal data with third parties except as required for payment processing (Stripe) or as required by law.

Article 12 – Complaints

12.1 Any complaints regarding our services should be submitted in writing to info@nestaquarel.com within 14 days of the relevant event or class.

12.2 We will respond to complaints within 14 business days of receipt.

12.3 If a complaint cannot be resolved amicably, the participant may submit a dispute to the relevant Dutch consumer dispute resolution body (Geschillencommissie) or contact the ACM (Autoriteit Consument & Markt).

Article 13 – Governing Law

These Terms and Conditions are governed by Dutch law. Any disputes arising from or in connection with these Terms and Conditions shall be submitted to the competent court in the Netherlands, without prejudice to the right of consumers to rely on mandatory provisions of the law of their country of residence.
